San Antonio Preparers Draw Ban

Pete Escalante Gutierrez and Jeanette Gutierrez of San Antonio, Texas, have been permanently barred from preparing federal tax returns for others. A federal court took the actions against the two this week and although the injunction permits four companies they own to continue to operate, although the Gutierrezes must sell their interests them.
Those companies are FCRE Inc., Fast Cash Refund Express Electronic Tax Service LLC, Fast Cash Refund Express and Fast Cash Express Electronic Services. Prior to the sale, the couple cannot handle anything other than administrative matters. The organizations are permanently barred from promoting any false tax schemes and from advising or encouraging taxpayers to attempt to evade federal taxes. The businesses must also turn over the names of those for whom they prepared tax returns or claimed refunds since Jan. 1, 2012.

The government alleged the Gutierrezes claimed false and exaggerated personal and business deductions and educational, energy and other credits that they were not entitled to. The tax loss is estimated at more than $3 million from 2006 through 2010. An audit in 2010 found that all 58 returns selected understated taxes owed.
